هذا الكتاب من الكتب النادرة وهو عبارة عن مخطوط كتب عام 575ه / 1179 -1180م وكان متداولاً في نسخه العربية مدة قرنين من الزمن، ولكن في عام 1859 نشر "مللر" في ميونخ هذا الكتاب، فأثار اهتماماً بين طلاب الفلسفة العربية. وتلا ذلك طبعة في القاهرة وطبعة في الجزائر وجميع هذه الطبعات اعتمدت على مصدرين: الأول مخطوط وجد في مكتبة الاسكوريال يرجع تاريخه إلى عام 724ه / 1323 – 1324م. وهذا الكتاب الذي بين أيدينا يعتمد على المخطوطين والذي جاء بعنوان "كتاب فصل المقال وتقرير ما بين الشريعة والحكمة من الإتصال".
يبدأ الكتاب بتعريف إبن رشد وآثاره العلمية ومنهجه في البحث. وهو "أبو الوليد محمد بن أحمد بن رشد، ولد في قرطبة في بيت اشتهر بالعلم والفقه ودرس إبن رشد الشريعة على الطريقة الأشعرية، والفقه على المذهب المالكي. ثم درس الطب والرياضيات والحكمة، واشتغل على كتاب أرسطو، ووضع كتاب أسماه "الكليات" ...".
ومما جاء في كتاب فصل المقال" "هو دفاع شكلي عن حق الفلاسفة في تأويل الشرع على ضوء المنطق، شريطة ألا ينكروا أصلاً من اصول الدين. وهذه الأصول هي القول بوجود الله، وإرساله الأنبياء، ويوم الحساب. فلا يمكن تكفير الفلاسفة إذا اجتهدوا في تفهم الذات الإلهية، وكيفية وجود العالم عن الله، وكيفية المعاد مثلاً".
يدافع إبن رشد في كتابه هذا عن حق التأويل لكن هناك شرط في استخدام هذا الحق "وهو عدم التصريح بالتأويل لمن هو ليس من أهله، لأن من فعل ذلك فإنه يدخل الشك في عقول العامة من الناس، والشك غالباً ما يؤدي إلى الكفر. فيكون المصرح بالتأويل سبباً في كفر الآخرين الذين لا يفهمونه". لقد كان هدف إبن رشد من هذا الكتاب رفع تهمة الكفر التي وصم الغزالي بها الفلاسفة واتهامه بأنه أخطأ حين أشرك السواد الأعظم من الناس في مسائل فوق مستوى عقولهم. ويعتمد في ذلك إبن رشد أي في دفاعه عن هذا الحق على عدد من الآيات القرآنية والأحاديث، مما يعطي قوة لدفاعه ضد كل من يرى في الفلسفة زندقة.
