بالرغم من التقدّم الهائل الذي شهدته المعاملات الإلكترونية في العصر الحديث فما زالت هناك بعض المعوّقات التي تعترض هذه التعاملات، تتمثل أساساً في إفتقارها حتى الآن إلى عنصري الأمن والسرّية نتيجة أعمال القرصنة والتدخّلات غير المشروعة التي تتعرّض لها، بالإضافة إلى صعوبة إثبات هذه التعاملات والتوثّق من محتواها وصدورها عمّن نسبت إليه دون تحريف أو تبديل أو تغيير.
إلا أن هذه المعوقات لم تقف حائلاً أمام تقدّم التعاملات الإلكترونية عامة والتجارة الإلكترونية خاصة، فظهرت إلى حيّز الوجود وسائل جديدة تستجيب لمقتضيات هذا التقدّم، فظهر التوقيع الإلكتروني إلى جانب التوقيع التقليدي ليؤكّد هويّة المتعاقدين ويعبر عن إرادتهم في التعاقد، وقد أقرّت معظم التشريعات للتوقيع الإلكتروني بالحجية ذاتها المقرّرة للتوقيع التقليدي في الإثبات إذا ما استوفى شروطاً معينة تعزّزه وتبعث الثقة فيه.
وقد تضافرت الجهود الدولية والإقليمية والوطنية لتنظيم عمل جهات التوثيق الإلكتروني والشهادات الصادرة عنها، وتحديد مسؤوليتها في حال إخلالها بالإلتزامات المترتّبة عليها في تعويض الطرف المتضرّر سواء أكان صاحب الشهادة أم الغير الذي اعتمد على الشهادة الصادرة عنها.
وعليه تتمثّل أهميّة هذه الدراسة في وضع إطار للنظام القانوني للتوثيق الإلكتروني للرسائل والتواقيع الإلكترونية، وبيان المسؤولية المدنية المرتّبة على جهات التوثيق الإلكتروني في حال إخلالها بالإلتزامات المترتّبة عليها، ونطاق هذه المسؤولية.
ولتحقيق ذلك جاءت هذه الدراسة في فصلين: الفصل الأول: ويتناول النظام القانوني للتوثيق الإلكتروني، أما الفصل الثاني: يناقش النظام القانوني للمسؤولية المدنية لجهات التوثيق الإلكتروني.
