أن العلاقة التي تنشأ بين الدولة والمكلفين بالضريبة هي علاقة مديونية مصدرها القانون وفي هذه العلاقة التي تنطوي على جانبين دائن (السلطة المالية) ومدين (المكلف)، يلتزم بموجبها المكلف باداء مبلغ نقدي بدون مقابل إلى الطرف الأول، ومن الطبيعي أن يترتب على هذه العلاقة التزامات وحقوق على كلا الطرفين.
وتكمن الغاية من خلال إعداد هذا البحث في إبراز خصوصية دين الضريبة عن الدين العادي أي بيان العناصر التي تميز الإلتزام في دين الضريبة عن الإلتزامات الأخرى في إطار القانون الخاص.
وقد تم تناول موضوع الدراسة وفق الترتيب التالي: تناول الفصل الأول الملامح الرئيسية لاستقلالية القانون الضريبي، إذ بيَت فيه المؤلف إنتماء القانون الضريبي غلى القانون العام، وفي الوقت ذاته إبرز إستقلال القانون الضريبي عن فروع القانون العام والخاص.
أما الفصل الثاني فلقد أوضح فيه المرتكزات الأساسية للإلتزام بدين الضريبة من حيث بيان مصدر هذا الإلتزام وأطراف الإلتزام ومحل الإلتزام.
في حين درس في الفصل الثالث تحديد وعاء الضريبة وتحقق دين الضريبة من حيث طرق تقدير دين الضريبة والشروط الواجبة لربط الضريبة.
وأخيراً خصص الفصل الخامس لبحث ضمانات تنفيذ الإلتزام بدين الضريبة من حيث الوسائل التي تملكها السلطة المالية والتي تتمتع بها لتامين الحصول على الحقوق المالية للخزانة العامة.
ثم إنتهى إلى الخاتمة وضَمنها لأهم إستنتاجاته وتوصياته.
