تصدرت قضية المرأة وحمايتها في القانون الدولي مكانة مهمة في الآونة الأخيرة، وظهر ذلك جلياً من خلال اعتماد مجموعة من الصكوك القانونية الدولية التي تندرج في نطاق القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني، ويعود ذلك إلى إنتشار ظاهرة النزاعات المسلحة الدولية وغير الدولية، والتي تسبب أضرار كبيرة، وتخلف عدد هائل من الضحايا، ويأتي في مقدمة الفئات المتضررة من هذه النزاعات تلك الفئات الضعيفة والمستضعفة، ومنها المرأة، التي تدفع فاتورة مضاعفة نتيجة عدم إحترام الأطراف المتحاربة لقواعد القانون الدولي الإنساني، لا سيما القواعد الخاصة بحماية المرأة زمن النزاعات المسلحة من ناحية، ولأن الإعتداء على المراة صار إستراتيجية في الحروب الحديثة تهدف إلى إذلال الطرف المحارب وإجباره على الإستسلام من ناحية ثانية.
لذا، يأتي هذا الكتاب ليكشف النقاب عن الواقع الحقيقي الذي تعيشه المرأة زمن النزاعات المسلحة، ومدى إستفادتها من القواعد القانونية الخاصة بحمايتها، وبيان سبب عدم إحترام الأطراف المتجاربة لهذه القواعد، وهل يمكن هذا السبب في ضعف هذه القواعد وقصور يكتنفها، أم أنه يعود لعدم وجود آليات قانونية حقيقية لملاحقة ومحاسبة منتهكي هذه القواعد.
