لسنا بالضرورة في بحثنا هذا مع نظريّة ولاية الفقيه أو ضدّها، ولكنّنا نهدف إلى المعرفة بوجه عام؛ المعرفة بأصول النظريّة العقائديّة، والمعرفة بتطوراتها عبر التاريخ، والمعرفة بكيفيّة ممارستها وتطبيقها في الجمهورية الإسلاميّة في إيران.
ولا شك في أنّ مسألة ولاية الفقيه ليست مسألة فقهية أو كلاميّة مستحدثة، بل هي قضيّة أصيلة بأصالة الفقه وقدم الفقهاء، فقد تناولها بالبحث والتنقيب علماء الإماميّة من الشيخ المفيد إلى المعاصرين من الفقهاء، وصرّح بعضهم بأنّها من البديهيّات والمسلمات في الفقه الإماميّ وعارضها آخرون، وبين هذا وذاك، ولاية الفقيه تمثّل أهم المفاهيم الأساسية لتطور الفكر السياسي الشيعي في عصر الغيبة... وهي تهدف إلى ضبط العلاقة بين الشعب والحاكم، على أساس الولاية الدينيّة والسياسيّة للفقيه في عصر الغيبة نيابة عن الإمام المعصوم... وسوف نعتمد في دراستنا على المنهج الوصفي، في تتبع النظرية وعرض مراحل تطورها منذ نشأتها حتى الوقت الحالي...
وتهدف الدراسة إلى إلقاء الضوء على نظرية "ولاية الفقيه" وأصولها في الفقه الشيعي، وإجتهادات فقهاء الشيعة منذ بدء "عصر الغيبة" لإستجلاء النظريّة وشرح معطياتها، ثم مراحل تحول النظرية من نظرية عقائديّة إلى منهج سياسيّ قامت على أساسه جمهورية إيران الإسلامية، ثم تنتقل الدراسة إلى طرح أسس النظرية كما فسّرها الإمام الخميني، ثم يتناول البحث الإجتهادات الفقهيّة السياسيّة المختلفة لشرح النظريّة بعد الثورة، ومن ثمّ سن الدستور وتعديله على أساس ولاية الفقيه.
