إن هذه الأطروحة تتناول أهلية المرأة في الشريعة الإسلامية، والأهلية من صفات الأشخاص، والشخص الطبيعي هو الإنسان رجلاً أو امرأة. فقد خلق الله عز وجل الإنسـان، وخصه بقابلية التكليف، بأن جعل فيه قوة فهم الخطاب، والقدرة على الاختيار؛ ليصير أهلاً للامتثال بالفعل أو الترك. وهذه القابلية هي الأهليـة؛ أي: الصفة التي يصبح الإنسـان بموجبها قابلاً لتعلق خطاب الشارع بأفعاله وأقواله، وهي تعتمد أصلاً على الإنسانية ويناط كمالها باعتدال العقل، ويترتب على اتصاف الإنسان بها ثبوت جملة من الواجبات عليه، وجملة من الحقوق والمصالح له التي لا بد منها لنهوضه بتلك الواجبات...
والأهلية شرط لجميع التصرفات التي تجري فيها الصحة والبطلان، كما أن العبادات الدينية تتطلب نوعين من الأهلية، أهلية لصحة صدور العبادة من الشخص، وأهلية لوجـوب هذه العبادة عليـه، والعقوبات الجزائيـة كذلك بمختلف أنواعها لا بد لاستحقاقها شرعاً وقانوناً من وجود أهلية في الجاني لتحمل التبعة والمسؤولية الجزائية.
ولما كان هذا البحث يختص بأهلية المرأة، فإن التوصل إلى رسـم ملامح أهلية المرأة في الفقه الإسلامي، وبيان حدود هذه الأهلية ومدى كمالها واستقلالها أو نقصانها وتبعيتها للغير، ورصـد ما تختلف بـه عن أهلية إخوانها من الرجال، لا بد وأن يكون مبنياً على استقراء الأحكام الثابتة في حقها في المجالات المختلفة مما له تعلق بكمال الأهلية أوقصـورها، مما يوصل إلى النظرية التي تحكم ما قد تختلف فيه أهلية المرأة عن أهلية الرجل.
