يسعى هذا الكتاب إلى الإجابة عن العديد من التساؤلات والتي لا تسعف النصوص القانونية في الإجابة عنها، ومن هذه التساؤلات: ما المقصود بالعوارض العامة في الإضبارة التنفيذية؟ وما تأثير هذه العوارض على هذه الإضبارة؟... 1-تحديد المقصود بالإلتزام بالرد العيني، أي ما معنى قاعدة إعادة الحال إلى ما كان عليه نتيجة صدور حكم الإلغاء؟ وهل هذا الأمر ممكن؟... 2-هل أن قاعدة الإلتزام بالرد العيني، أي قاعدة إعادة الحال إلى ما كان عليه قبل التنفيذ قائمة على فكرة الحق أم الإلتزام؟... 3-كيفية تحديد الصورة الدقيقة لتنفيذ الإلتزام بالرد العيني - التنفيذ العكسي؟... وغيرها الكثير.
وللإجابة عن هذه التساؤلات توزعت الدراسة في هذا الكتاب إلى ثلاثة فصول، الفصل الأول جاء بعنوان العوارض العامة للإضبارة التنفيذية وكان في ثلاثة مباحث، المبحث الأول في وقف التنفيذ، أما المبحث الثاني، فإنه يبحث في تأخير التنفيذ، والمبحث الثالث فيتناول التقادم المسقط للتنفيذ وسقوط حق المطالبة بالأمانات.
أما الفصل الثاني فهو بعنوان العوارض الخاصة للإضبارة التنفيذية، وهو أيضاً في ثلاثة مباحث، المبحث الأول يتطرق إلى مضمون الإلتزام بالرد العيني، أما المبحث الثاني، فهو يعالج عوارض الإلتزام بالرد العيني، أما المبحث الثالث فهو يتناول تنفيذ الإلتزام بالرد العيني وهو ما يصطلح عليه بالتنفيذ العكسي.
أما الفصل الثالث فكان بعنوان تطبيق خاص لفكرة حوالة الحق وأثرها على الإلتزام بالرد العيني في الإضبارة التنفيذية ويقع هذا الفصل في مبحثين المبحث الأول يتناول التعريف بالإلتزام بالرد العيني، أما المبحث الثاني فقد جاء تحت عنوان نطاق الإلتزام بالرد العيني وأثر الحوالة عليه.
