إن تجربة فقه المعاملات المعاصرة بالرغم من كثرة الإنتاج الذي قدمته على مستوى مسائل النوازل، إلا أنها لا تزال تحتاج إلى دراسات تعيد تقييم طبيعة هذا الإنتاج وتكشف عن منهجية حركته، وآليات اشتغاله.
ولأن هذا الكتاب جاء لا ليبحث في نتائج آراء المعاصرين في مسائل المعاملات المعاصرة؛ فالمكتبة الفقهية تزخر بكثير من جنس هذه الدارسات، لكنه جاء ليبحث في منطق التفكير الفقهي الذي كان يحكم هؤلاء الفقهاء وهم ينتجون تلك الآراء.
هذا الكتاب يحاول أن يراجع التفكير الفقهي المعاصر في واحدٍ من ممارساته المركزية والتي تتعلق بطبيعة نظره للعقود المالية، هل كان ينظر إلى شكل تلك العقود أم إلى مضمونها؟ هل كان ينظر إلى المقاصد أم الظواهر؟ ويحاول أن يربط بين هذا التفكير الفقهي المعاصر والجذور التي تأثر بها في المدارس الفقهية القديمة.
وهذه هي حلقة من حلقات قراءات في الخطاب الشرعي، التي تقصد إلى تطوير هذا الخطاب وتنميته وتأهيله من جديد.
