لما كان القضاء العام هو الملاذ الذي تحيطه الدولة بضمانات تكفل تحقيق العدالة وتوفره للأفراد من أجل الحصول على حقوقهم عند نشوء النزاعات بينهم، ولما كانت الدعوى هي الوسيلة لحماية هذه الحقوق، أصبح اللجوء إلى القضاء في العصر الحديث أمراً غيرَ محببٍ نظراً لكون إجراءات التقاضي التقليدية مكلفة وتتّسم بالتعقيد وتطيل أمد التقاضي وتؤدي إلى إزدياد وتراكم أعداد الدعاوى المنظورة أمام المحاكم مما يترتب عليه بطء النظر فيها، حيث أن هذا الأمر لم يعد يتناسب مع التطور الهائل بعالم التجارة والتقدم الحاصل في سهولة وسرعة الإتصالات وتزايد العقود المدنية والمبادلات التجارية في العقود القليلة المنصرمة وإنعكاس ذلك على تطور العلاقات التي تربط الأفراد ببعضهم البعض وخاصة عقود التجارة الدولية وتقلب أسعار العملات وإختلال التوازن النقدي والتي تجاوزت الحدود الجغرافية للدولة.
يتناول هذا الموضوع في ثلاثة مباحث وملاحق على النحو الآتي: "المبحث الأول: الوسائل البديلة لحل النزاعات": أولاً: ماهية الوسائل البديلة لحل النزاعات، ثانياً: أنواع الوسائل البديلة لحل النزاعات، ثالثاً: مصادر الوسائل البديلة لحل النزاعات، رابعاً: مميزات الوسائل البديلة لحل النزاعات.
أما "المبحث الثاني: الوساطة لتسوية النزاعات المدنية": أولاً: التعريف بالوساطة في النظام القانوني، ثانياً: مقارنة الوساطة مع غيرها من وسائل حل النزاعات، ثالثاً: خصائص الوساطة، رابعاً: أنواع الوساطة، خامساً: اللجوء إلى الوساطة، سادساً: الأنماط المتبعة في عملية الوساطة، سابعاً: الأطراف المشاركة في عملية الوساطة، ثامناً: المتطلبات الواجب توافرها في الوسيط، تاسعاً: الحياد في عملية الوساطة، عاشراً: عملية الوساطة.
والمبحث الثالث: "ممارسة الوساطة في الأردن": أولاً: المعيقات التي واجهت الوساطة في الأردن، ثانياً: تطوير الوساطة في الأردن.
