إنّ السلطات الممنوحة للموظف، إنَّما مُنِحت له لخدمة المواطنين وإنجاز مصالحهم بالطُرُق القانونيَّة، دون إلزام المواطنين تحمُّل نفقات إضافية، إلاَّ أنَّ البعض يَعمد إلى سوء إستعمال السَلطة لتحقيق مكاسب شخصيَّة مُخالِفاً بذلك القوانين والانظمة التي تحدّد واجبات الوظيفة.
إنّ جريمة الرشوة هي من أهمّ جرائم الفساد الإداري، والّتي أصابت المجتمعات دون إستثناء، لكونها باتَت تهدِّد مصداقية وفعاليّة السلطة ومؤسساتها، وتُشكِّل أحدى أهمّ المعوّقات والتّحديات الّتي تحوُل بين الشعوب وحقَّها في التَّنمية والتطوّر، فقد حظيَ موضوع مكافحتها إهتمام الدّول والمنظَّمات الدّولية في سبيل مواجهتها والحدِّ منها.
كما إنَّ التقارير والدراسات الدورية، أثبتت بدليلٍ لا يقبل الشكّ أنَّ معدلات إرتكاب جريمة الرشوة في إزدياد، رغم سنّ الدولة التّشريعات الجزائية الّتي تُعاقِب مُرتكبها، وإتّخاذ وسائل وقائية في سبيلِ الحدِّ من إنتشارها، ما يضع علامة إستفهام في مدى نجاحها.
ولأنَّ لبنان والعراق لم يكونا بمنأى عن آثار هذه الجريمة المُدمّرة، فقد سعيا، ومنذ فترة طويلة إلى مكافحتها بوسائل وقائيّة وأخرى جزائيّة، ومع ذلك، استمرَّ إنتشارها في هذين البلدين على نطاقٍ واسع يوماً بعد يوم، لدرجة أضحت موضوعاً مهمّاً في دراسة واقع هذه الجريمة، وبيان الأسباب الّتي تقف وراءها.
ومن أجل التعرّض لتلكَ الجهود وتقويمها في ظلِّ النصوص الجزائية اللِّبنانية والعراقيّة من جهة، وإحكام إتِّفاقية الامم المتَّحدة لمكافحة الفساد 2003، وإتفاقية الأمم المتحدة لمكافحة الجريمة المنظّمة عبر الحدود الوطنية 2000 من جهة أخرى، تتعرض هذه الدراسة إلى التعريف بجريمة الرشوة وطنياً ودولياً وذلك في القسم الأول.
اما القسم الثاني من هذه الدراسة فتناولت وسائل المكافحة، الوقائية منها والجزائية، وطنياً ودوليا، لبيان مدى تنفيذ لبنان والعراق للوسائل والتدابير الّتي ضمتها تلك الإتّفاقيات، وصولاً غلى تحديد الثغرات الّتي وسمت التشريعات الجزائية اللّبنانية والعراقيّة.
