يجمع هذا الكتاب ما بين دفتيه مجموعة من البحوث كتبها الدكتور "طارق كاظم عجيل" أستاذ القانون المدني ورئيس قسم القانون الخاص في جامعة ذي قار في العراق – وقد نشر بعض هذه البحوث سابقاً في مجلات علمية محكمة، أما البعض الآخر فهي عبارة عن محاضرات ألقيت في مؤتمرات علمية عقدتها كليات القانون في داخل العراق وخارجه.
وإيماناً من الكاتب بأن البحث العلمي فيه من المعلومات والتحليلات والنتائج العلمية ما لا يوجد في المؤلفات العامة، ارتأى جمع هذه البحوث في كتاب سماه "ثورة المعلومات وانعكاساتها على القانون المدني" من منطلق أن ثورة المعلومات هي قيمة تستحق الحماية القانونية.
لأجل ذلك، يقسم الكاتب موضوع دراسته إلى سبعة فصول تتضمن مباحث عدة. يبحث الفصل الأول في الملكية العلمية، أما الفصل الثاني فيبحث في المعلومات غير المفصح عنها والحماية القانونية لها. ويخصص الفصل الثالث لأحكام الأهلية في المعلومات الإلكترونية، ويتضمن الفصل الرابع التنظيم الإتفاقي للمفاوضات العقدية – دراسة في عقد التفاوض الإلكتروني. ويبحث الفصل الخامس في مفهوم مجلس العقد الإلكتروني. أما الفصل السادس فيدرس مدى ضمان العيب الخفي في عقود المعلوماتية، أما الفصل السابع والأخير فيسلط الأضواء على ماهية عقد نقل التكنولوجيا وضمانات نقلها دراسة تأصيلية في القانون المدني.
كتاب هام يشرح بشكل مسهب تفاصيل عقد نقل التكنولوجيا أي المعلومات الفنية التي يلتزم مصدر التكنولوجيا بتوريدها للمستهلك. وهذه المعلومات وإن لم تكن محلاً لبراءة اختراع فإن ذلك لا يمنع من تداولها، لذلك لا بد من تنظيمها من الناحية القانونية، فهي ليست صورة تقليدية من عقد البيع أو عقد المقاولة. بل هي عقد مقاولة من نوع خاص انعكست خصوصيته على الضمانات التي يمكن أن يتمتع بها المستورد في ظل هذا العقد. فما هي انعكاسات توظيف نتائج هذه التكنولوجيا على حياة الإنسان وكيف تتم حمايتها وفق إرادة المتعاقدين. هذا ما تبحث فيه هذه الدراسة ...
