إن معرفة قواعد أصول الفقه والأدلة المختلف فيها ؛ أمر ضروري لاستنباط الأحكام الشرعية، وفهمها، وإدراكها، والوقوف على المصالح التي استهدفها الشارع الحكيم. وفي دراسة أصول الفقه، بيان وجلاء لحقيقة اختلاف الأئمة والفقهاء وأنه اختلاف اجتهاد واستنباط، واحتجاج واستدلال، وبالتالي اختلاف في المنهج والمسالك، لا اختلاف في الأصل والمنبع. وقد تناول هذا الكتاب الأدلة المختلف فيها عند الأصوليين وتطبيقاتها المعاصرة، من خلال أربعة فصول : تناول الفصل الأول منها المصالح المرسلة، وفيه : ماهية المصلحة لغة واصطلاحا، وتقسيمات المصلحة، وضوابط المصلحة في الفقه الإسلامي، والنص والمصلحة، وفقه المصلحة وتطبيقات المعاصرة. وتضمن الفصل الثاني سد الذرائع، وفيه : ماهية الذرائع ومكانتها، وأراء العلماء في حجية الذرائع، وتقسيمات الذرائع عند الأصوليين، ومقارنة بين الذرائع والحيل، والتطبيقات المعاصرة على أصل سد الذرائع. وتناول الفصل الثالث العرف، وفيه : ماهية العرف، وحجية العرف وأدلة اعتباره، وشروط اعتبار العرف وتحكيمه، وتقسيمات العرف، وتطبيقات معاصرة على العرف. وتضمن الفصل الرابع والأخير الاستحسان، وفيه، تعريف الاستحسان، وتحرير محل النزاع بين العلماء في الاستحسان، وحجة الاستحسان وأدلته، وأنواع الاستحسان، والتطبيقات المعاصرة على أصل الاستحسان، وأخيرا الخاتمة، والمراجع.
