إن عقود التبرع الواردة على الملكية العقارية متنوعة، ومختلفة بحسب المراكز القانونية التي تنشأ عن كل عقد منها، ولقد تم حصرها في ثلاثة عقود تبرع مهمة وهي: (الوقف - الهبة - الوصية).
ولقد خصصنا هذا الكتاب لدراسة النوع الأول: (الوقف)، نظراً لخصوصية هذا العقد ولأهمية المراكز القانونية التي تنشأ عنه، والتي تغير في حق الملكية بشكل جذري ونهائي.
إن الوقف نظام قديم، عرفته نظم وشرائع سابقة على الإسلام، وإن لم يسم بهذا الإسم، ففكرة الوقف وجدت أشباها لها في النظم القديمة والشرائع السابقة، لكن في الإسلام وضع النظام في سياق مستقل بقواعده ومصادره، لتحاول التشريعات والنظم القانونية بعد ذلك وضع إطار قانوني يحكم هذا النوع من الأملاك العقارية والتي تدعى بالوقف، وكل ذلك على ضوء ما جاءت به أحكام الشريعة الإسلامية.
إذ أخذت التشريعات القانونية منها ضمنياً، بل ونصت في كثير من الأحيان على ضرورة الرجوع إلى أحكامها صراحة فيما لا نص فيه، لذلك نجد أغلب المواد القانونية المنظمة للوقف تمتزج برأي فقهي معين، إمتزاجاً يصعب فصل رأي القانون فيه عن رأي الفقه.
إلا أن هذا النوع من الأملاك بات يعاني مشاكل قانونية كثيرة، حاولنا من خلال هذا الكتاب كشف النقاب عنها، مع إعطاء حلول فعالة للنهوض بها وحمايتها وتنميتها بأسلوب حديث.
