إن مسألة الترتب من المسائل الدقيقة والمعقدة جداً ، التي وقع فيها اختلاف آراء الأصوليين بين نافٍ ومثبت ، فلا يوجد لها ذكراً في كتب المتقدمين ، ولأنه لا توجد دراسة تذكر عن مسألة الترتب اختار الدكتور ضرغام كريم كاظم الموسوي الكتابة عنها تحت عنوان " الترتب وآثاره الفقهية " فبيّن نشوءها ، ودرس مبادئها ، وأسباب القول بها ، وبيّن حدودها وشروطها .
والرواتب هي النوافل اليومية لأنها ثابتة إما من جهة الوقت أو الفرائض ، أما في المعنى فإن اللغويين يطلقون الترتب على معانٍ عدة هي : الدوام ، والثبوت ، والإستقرار ، والإقامة ، لكن هذه المعاني كلها ترجع إلى معنى واحد هو ( الثبوت ) ، وثمة علاقة ومناسبة بين المعنى اللغوي ، والمعنى الإصطلاحي ، والمؤلف يجد " أن معنى الثبوت هو أنسب المعاني التي ذكرت لمعنى الترتب ... " .
وبناءاً على ما تقدم ، ولدقة المسألة عرض المؤلف لموضوعه بتمهيد ( في مفهوم الترتب ) ثم بحث عن أصل المسألة هل هي أصولية أم فقهية ، وخرج بأنها " مسألة أصولية عقلية " ، وأما الفصل الأول فجاء بعنوان ( مبادىء الترتب ) ، وتضمن المبادىء التي ينطلق منها الترتب ، ويُبتني عليها ، فبحث في " مسألة الضد " وما تترتب عليها من نتائج وآثار فقهية ، كما تناول معنى ( التزاحم ) و ( التعارض ) ، و ( القدرة ) وشرح كل واحدة منها واستعمالاتها وحكمها . وأما الفصل الثاني فجاء بعنوان ( إمكان الترتب ، وشروطه ) ، وتناول إمكان الترتب وشروطه وأبرز الأدلة التي تدل على إمكان الترتب وأقوال العلماء فيها ، وأدلة النافين مع ذكر ردود العلماء عليها . وجاء الفصل الثالث والأخير بعنوان ( الآثار الفقهية للترتب ) واعتبره المؤلف ميداناً عملياً لآثار مسألة الترتب ، وهو أثر الترتب في تزاحم الأهم والمهم ، إذ عرض المؤلف مجموعة من الفروع التي أفتي فيها بصحة الضد العبادي المهم عند مزاحمة الأمر الأهم اعتماداً على مسألة الترتب ، وذكر أمثلة لعدد من الحالات مع بيان أقوال العلماء واختلافهم فيها ...
