يعتبر العقد بشكل عام أهم مصدر من مصادر الإلتزامات الإرادية، وحيث إن المصادر الإرادية هي الأصل حسب ما قررته نظرية سلطان الإرادة بإعتبار أن إرادة الشخص هي المصدر الرئيسي لإنشاء الإلتزامات في ذمته، وحيث إن عقدي البيع والإيجار تعتبر أهم أنواع العقود المسماة، ويرجع ذلك إلى أن هذين العقدين فقط هما السائدان في ترتيب الإلتزامات على الأشخاص، وحيث إن المشرع العماني كغيره من المشرعين أورد مجموعة من العقود في قانون المعاملات المدنية العماني رقم (29/ 2013) ونظمها بأحكام خاصة وهي ما يطلق عليها بالعقود المسماة فإن هذه الدراسة ستتضمن هذين العقدين حسب ما أورده المشرع العماني في قانون المعاملات المدنية، إضافة إلى القانون الخاص الذي نظم العلاقات الإيجارية بين ملاك ومستأجري المساكن والمحال التجارية والصناعية رقم (6/ 89) وتعديلاته.
