هذا نص فتوى للحافظ ابن حجر في وقف مجاور للحرم سئل فيه عن حكم تجديد شباك زائد في مكان من الدار الموقوفة، لينتفع به من يقيم في ذلك المكان بمزيد الاستضاءة ومشاهدة الكعبة، فأجاب بجوابين مؤادهما واحد:
أحدهما: فيه نوع من التوسع والاستطراد، إذ استغرق قرابة خمس ورقات، وهو المقصود من هذا الإخراج.
والآخر: مقتضب لم يتعد ورقة واحدة، وهو في الجوابين قد بنى فتواه على مذهب الشافعي، وخرجها على قولين للسبكي وواحد لابن الصلاح، واختار أوسط الأقوال منها.
وقد وصف السائل ابن حجر بقاضي القضاة، وهو ما يدل على أنه صار أمكن في الفتوى من ذي قبل، لأن "نظر القاضي أوسع من نظر المفتي"، ويدل كذلك على أنه حرر هذه الفتوى وقد تجاوز الخمسين من عمره، وبلغ منزلة علمية عالية ومكانة اجتماعية سامية في زمانه، فالفتوى والقضاء وظيفتان لا تمنحان في ذلك الوقت إلا لعالم مقتدر مجتهد ولو في المذهب.
