يكون البحث في البطلان إجراءات التحقيق الإبتدائي مفيداً ومهما إذ علمنا أن إجراءات التحقيق وكما بينا سلفاً هي من أكثر الإجراءات تماساً مع حقوق الأفراد وحرياتهم، وإن إحتمال الإساءة في مباشرة هذه الإجراءات (كإجراءات التوقيف والقبض والتفتيش والإستجواب) وارد، خصوصاً إذا علمنا أن جزءً كبيراً من إجراءات التحقيق يباشرها أعضاء الضبط القضائي وأفراد الشرطة وإحتمال إساءة بعض من هؤلاء الأشخاص مع إحترامنا الشديدة لهم غير بعدة، وقد تكون الإساءة بناء على فهم خاطئ وقلة إدراك وفهم لنصوص وقواعد القانون، وقد تكون بناء على قصد مثل الإنتقام بسبب العداوة، أو بسبب فرض السيطرة والإبتزاز وغيرها من الدوافع.
بالإضافة إلى ما تقدم، فإن بطلان إجراءات التحقيق الإبتدائي لا يختلف عن البطلان باقي الإجراءات الجنائية، إلا من حيث كثرة وتشعب الإجراءات التحقيقية، وإختلاف الأشخاص المباشرة لهذه الإجراءات؛ ولذلك اخترنا أن نبحث في بطلان إجراءات التحقيق الإبتدائي لأهمية إجراءات التحقيق ولتوضيح بعض المشاكل التي قد يثيرها التحقيق الإبتدائي بسبب كثرة وتشعب إجراءات وإختلاف الأشخاص القائمين بهذه الإجراءات.
