حين تعرضت الشريعة الإسلامية لأذى المغرضين وحين عمد المغرضون إلى الخلط بين الرأى والفتوى وحين راى المغرضون ان يلبسوا اعتداءاتهم ثوب العلم المزيف، وأطلقوا عليه اسم الاجتهاد، راى بعض المفكرين ان يوقفوا هذه المهزلة الفكرية او على الأقل يحاولوا احياء الحمية في نفوس بعض أفراد الأمة لينتبهوا إلى الخطر الذي يأيتهم تحت شعار غربي يقول: " إن الشجرة لابد ان يقطعها أصحابها" وكان من بين هوؤلاء الكتاب الاستاذ الدكتور طه حبيشي وهو من علماء الأزهر ومن أساتذة كلية أصول الدين فقد حاول ان يقدم للناس الاجتهاد وشروطه ويشرح لهم المصلحة الشرعية ويبين حدودها ثم يبين الفرق بين المصلحة والمنفعة على نحو ما يفهمها كبير القانونين في الغرب وهو مسيو بنتام ثم راى غفر الله له ان يضع الحدود الفاصلة بين السنة والبدعة وبين البدعة والمصالح المرسلة ثم ختم بحثة الذي بين يديك بضرح مفصل للفتوى والمتفى والمستفتي مبينا حدود المسئولية في كل. ولقد عمد الباحث هنا إلى اليسر والسهولة في الأسلوب مع صعوبة المسائل وصعوبة استخراجها من بطون الكتب. وتبقى مسئولية القارئ أن يبذل من جهده ويتحمل من مسئوليته الدينية استيعابه لهذا المنهج استيعابا كافيا حتى نقابل ربنا ونحن على بياض القلب وبياض الوجوه.
