Book Description
الشريعة الإسلامية هي آخر الشرائع الإلهية التي جاءت لتحقيق سعادة البشرية، وهدايتهم إلى ما فيه الخير والرشاد، ولذا فإنها جاءت جامعة مانعة كاملة البيان، وافية بأغراض البشر ومقاصدهم، ومسايرة لجميع الأزمنة والأمكنة؛ فنظمت علاقة الإنسان بخالقه ومولاه، وعلاقته بأخيه الإنسان على أتم تنظيم وأكمل بيان. وسلكت الشريعة مسلكًا فريدًا في قانون العقوبات للمحافظة على مصالح الناس، وحماية المجتمع من الرذيلة وما يهدم كيان المجتمعات، ذلك لأن المشرع الحكيم يريد من مجتمع الإسلام مجتمعًا عريقة أصوله، متعاونة أفراده على البر والخير، ولا يتحقق ذلك إلا إذا كانت علاقة الإنسان بخاصته وقراباته قائمة على المودة والتراحم والاحتشام، لا سيما وأن هذه القرابات هي أصل تكوين المجتمعات أو هي اللبنة الأساسية في بناء المجتمعات.
لذا فقد ميز الشارع الحكيم قرابات الإنسان، بمزيد من الرعاية والبر والإحسان، بل وتوعد القاطع لرحمه بأشد أنواع العذاب وذلك محافظة على الأنساب وتكريمًا لبني الإنسان. فأثبت لهم الولاية، وحرم الزواج بأخص القرابات وعلل ذلك (صلى الله عليه وسلم) بقوله (إنكم إن فعلتم ذلك قطعتم أرحامكم). حيث يهتم الكتاب بتبيان دور القرابة على اختلاف صوره وفروعه، كما يعد الكتاب دراسة فقهية تطبيقية لكل أنواع القرابة وأثرها على الجرائم وعقوباتها لكل نوع على حدة مع بيان نوع ذلك الأثر إيجابيًا أو سلبيًا على الجريمة ثم على العقوبة، سواء كانت جناية أو جريمة من جرائم الحدود أو من قبيل التعزير.
