أهم الأسباب في إختيار هذا الموضوع هو أنَّ أغلب الباحثين في القانون الدولي الخاص أنَّهم لم يعيروا لموضع مركز الأجانب أهمية بعكس تنازع القوانين أو الجنسية فموضوع مركز الأجانب تعده الدول وخاصةً الأوروبية مِنْ أهم المواضيع وتطبيقاً لذلك نجد أنَّ القوانين موضع المقارنة كقانون دخول وإقامة الأجانب وحق اللجوء الفرنسي لسنة 2004، قدْ عالجت هذا الموضوع في قانون جديد لأهميتهِ، وكذلك الحال بالنسبة للمشرع المصري الذي أصدر قانون رقم (88) لسنة 2005 بشأن دخول وإقامة الأجانب بأراضي جمهورية مصر العربية والخروج منها، أمَّا بالنسبة للمشرع العراقي فإنه إلى الآن متمسكٌ بقانون إقامة الأجانب رقم (118) لسنة 1978 وهذا القانون يشوبه الكثير من النقص والقصور في الوقت الحاضر.
