هذا البحث وهو التشويه الجسدي والقصور العقلي بين الحكم والحكمة والقانون عبارة عن مجموعة مواضيع متفرقة خطها السيد محمد الصدر والجامع لهذه المواضيع كما لا يخفى هو النقص الحاصل في الجسم تارة وفي العقل تارة أخرى. فكل نقص تابع للعقل سواء من الناحية الظاهرية أو المعنوية أو الأخلاقية فهو القصور العقلي. كالجنون والسفه والجنون الأخلاقي وتدني مستوى العقل العلمي ومستوى العقل العقائدي والميل إلى الباطل كلياً، والاضطراب وما إلى ذلك... والنقص التابع للجسم سواء من الناحية الظاهرية أو الداخلية للجسم فهو التشويه الجسدي قل أو كثر وسواء كان التشويه ناتجاً عن زيادة في الجسم أو عن نقصان.
كما أننا نجد في هذا الكتاب يبحث في مفردات القانون المدني المتعلق في الموضوع أي موضوع النقص أو التشويع الجسدي أو القصور العقلي. ويناقش هذه المفردات ويثبت صحتها أو عدم صحتها كلياً أو جزئياً.
كما أننا نجد هذا الكتاب يتعرض إلى بيان طبي حول بعض ما يتعلق بالقصور العقلي وعلاقة الجانب الطبي بالحكم الفقهي، وهل أن كل ما يعتبره الطب قصوراً عقلياً ينطبق عليه الحكم الفقهي الخاص بالقصور هذا. أم إن موارد الفقه ومصاديقه تختلف عن موارد ومصاديق الطب للقصور.
كما أننا نجد هذا الكتاب يتعرض إلى جملة معتد بها م ن الأحكام والمسائل الفقهية الجديدة المتعلقة بالمشوهين سواء على مستوى العقل أو الجسد. وهذه الأحكام مرتبة بشكل يسهل مراجعتها وتطبيقها.
