سلوك طريق امر الداء وجوبى وعدم اتباع هذا الطريق والالتجاء الى القواعد العامة فى الحالات التى يجب فيها سلوك طريق امر الداء من شانه أن يجعل الدعوى غير مقبولة أصلا لعدم سلوك الطريق القانونى لرفعها وتقضى المحكمة من تلقاء نفسها بذلك لتعلقة بالنظام العام وذلك سبب اتصاله باجراءات التقاضى وطرق رفع الدعاوى . لذلك راينا القاء الضوء على هذا الموضوع متجنبين الدخول فى تفصيلات النظريات الفقهية الا بالقدر الذى تقتضيه الدراسة العملية كما أننى اخترت أهم المشكلات العملية التى تثار بالنسبة لهذا الموضوع سواء من الناحية الموضوعية أو الناحية الاجرائية كما عنيت بأحكام القضاء عناية تامة وصلت فى بعض الاحيان الى حد الاسهاب وذلك لايمانى بأن اهمية أى بحث قانونى لا يتحقق إلا من خلال فائدته العملية . وكل أملى ان اكون -بهذا الجهد المتواضع - قد القيت بعض الضوء على هذا الموضوع لتكون الاستفادة اكثر لرجل القضاء الواقف والجالس .
