بعد ما أنشئت كلية الشريعة في جامعة دمشق رأي القائمون عليها أن رسالتها لا تنحصر في التدريس العالي لعلوم الشريعة وما يتصل بها وينير سبيلها من دراسات، بل يجب أن يكون لها عمل إنشائي ذو أثر بارز، ففكروا بمشروع (موسوعة الفقه الإسلامي) وهو مشروع عظيم جلل، غايته إعادة سبك الفقه الإسلامي بترتيب جديد على أساس الكلمات الاصطلاحية العنوانية ذات الدلالة على الموضوعات والمسائل الفقهية مرتبة تلك الكلمات العنوانية بحسب أوائل حروفها وفقًا لترتيب حروف الهجاء المسمى بالترتيب الأبجدي، وهو الترتيب الذي تتبعه معجمات اللغة لشرح مفرداتها. فكما يراجع الشخص معجمًا لغويًا عن كلمة ويستخرجها منه وفقًا لترتيب حروفها لكي يرى معناها اللغوي يراجع الباحث هذه الموسوعة الفقهية عن الكلمة ذات الدلالة على الموضوع الذي يريده، ويستخرجها من الموسوعة بالطريقة نفسها، أي بحسب ترتيب حروفها، ليرى ما تحتها من الأحكام الفقهية التي يقررها الفقهاء.
وفي أثناء هذا الطريق رأت اللجنة أن مما يتصل بهذا الغرض ويساعد على تعبيد طريقه أن تفهرس كتابًا فأكثر من أمهات كتب الفقه العام الجامعة فهرسة أبجدية تستوعب كل مباحثه ومسائله وتطبعها.
ووقع الاختيار على كتاب "المحلي". وقد كلفت اللجنة أحد أعضائها الأستاذ السيد محمد المنتصر الكتاني أستاذ التفسير والحديث النبوي أن يقوم باستعراض المحلي ووضع ذلك الفهرس الأبجدي لكل ما فيه من بحوث ومسائل، نظرًا لمزيد خبرة الأستاذ المنتصر بهذا الكتاب ومضموناته وانصرافه من عهد بعيد إلى دراسة الفقه الظاهري وابن حزم بتعمق واستيعاب، وهيأت اللجنة له من يعاونه في هذا العمل الجليل. فقام الأستاذ المنتصر بالعبء خير قيام.
ثم لما بدأ الأستاذ المنتصر العمل جدت له فكرة جديدة هي أن يقوم بتسجيل خلاصة الحكم الفقهي الذي يستقر عليه ابن حزم في كل موضوع تحت الكلمة العنوانية التي تدل عليه عندما يستخرجها ليصنفها في الفهرس. وبذلك يصبح الفهرس الأبجدي المراد وضعه للمحلي أشبه بموسوعة فقهية مصغرة تتضمن خلاصة فقه ابن حزم في المحلي.
