ما أحوجنا اليوم لمعرفة أحكام الإضطرابات العقليَّة والنفسيَّة، حيث أنَّها تُصيب أعداداً كبيرة من الناس في مُختلف مراحل العمر، ومن مُختلف المًستويات الإقتصاديَّة والإجتماعيَّة، فتُشكل بذلك مصدر خطر دائم على المُجتمع؛ فالمُضطرب قد لا يلحق الأذى بنفسه فقط، بل قد يؤذي غيره حتى أقرب الناس إليه، حيث أنَّ الإضطرابات تجعله لا يدرك تصرفاته أو لا يستطيع أنْ يختار بين إرتكابها من عدمه، وبالتالي قد يرتكب بعض الأفعال الإجراميَّة الشاذة التي ينهى عنها المُجتمع.
وتُعَدُّ الإضطرابات العقليَّة والنفسيَّة من القضايا المُستجدة، بسبب إنتشارها في مُجتمعنا المُعاصر، بالإضافة إلى كونها تتعلق بإثنين من موانع المسؤوليَّة الجنائيَّة، والمتمثلين بالمرض العقلي والنفسي، والسكر أو التخدير الإضطراري.
وقد عمدت إلى تناول الجانب الطبّي لتلك الإضطرابات والذي يشمل مفهومها وأنواعها وأسبابها، إضافة إلى تناول الجانب القانوني لها من خلال التطرق لعلاقتها بالإجرام والمسؤوليَّة الجنائيَّة للمُصاب بها، لعلنا نوفق في الإسهام بإضافة دراسة قانونيَّة ينتفع بها طلاب العلم، ولعلَّها ستُحدد مساراً يُساعد القاضي على السير فيها دون إرباك، إضافة إلى حاجة المُجتمع لمعرفة أحكام هذه الإضطرابات، لا سيّما الأسر التي يُبتلى أحد أفرادها بأحد أنواعها.
