من المعلوم أن للفقه الإسلامي اصول يستند عليها؛ وفي ضوئها تستبط الأحكام، ما أدى إلى أن يصبح لهذا الفقه قواعده واصوله وضوابطه، وهذا الكتاب –دراسة لسيرة المصطلح الفقهي ودلالة المفهوم فيما كتب ودوَن في كتب أصول الفقه المعروفة وضعها الكاتب في مقدمة وثلاثة فصول هي: الفصل الأول: الشريعة والفقه ويضم: 1- معنى الشريعة والفقه في اللغة والاصطلاح، 2- مقلصد التشريع الإسلامي، 3- تكوين الفقه، 4- العوامل الأولية في نشأة المدارس الفقهية، 5- أهمية الفقه الإسلامي، 6- نشأة التدوين الفقهي. أما الفصل الثاني فتحدث عن: التطور التاريخي للفقه الإسلامي ويضم 1- أدوار الفقه الإسلامي ويغطي: الدور الأول وهو: دور النشأة منذ بعثة الرسول (صلى الله عليه وسلم) في (13 قبل الهجرة- 101هـ/ 609-732م)؛ الدور الثاني: دور البناء والتكوين (يبدأ من أوائل القرن الثاني 101-350/ 719-961) وهو عهد الأئمة المجتهدين؛ الدور الثالث: دور التصنيف والتبويب (350-656/ 961-1258) ويقسم بدوره إلى مرحلتين: مرحلة "الدولة العباسية" ومرحلة "الدولة العثمانية"؛ الدور الرابع وهو: دور الانحطاط الفقهي (656-1286هـ/ 1258-1869م)؛ الدور الخامس وهو: دور اليقظة الفقهية 1286هـ/ 1869م وحتى وقتنا الحاضر. وأخيراً الفصل الثالث حول: أئمة المذاهب الفقهية وأسباب انتشارها وهم: الإمام أبو حنيفة، مالك بن أنس، الشافعي، أحمد بن حنبل، الأوزاعي، وابن حبرير الطبري. وختم بأسباب انتشار المذاهب الفقهية وشيوعها بين الانصار.
هذا، وقد أشار المؤلف في مقدمة الدراسة هذه أنه اعتمد على كتاب المستشرق "فريمان جرنفيل"، وهو بعنوان "التقويم التاريخي للمسلمين والمسيحيين".
