يعد عقد الإستشارات الهندسية العقد الأساس لمقاولات البناء والتشييد، وقد أخذ هذا العقد إنتشاراً في الواقع العملي المعاصر، وكثر تداوله في قطاع البناء والعمران لإشباع حاجاته الأساسية.
حيث إن تنفيذ مقاولات البناء والتشييد يحتاج إلى سلسلة من العقود بهدف تنظيم العلاقات القانونية بين أطراف العقد وبخاصة صاحب العمل والمقاول والمهندس، ويعد هذا العقد من العقود الحديثة نسبياً، والذي يمثل إنعكاساً للتطور الإقتصادي والإجتماعي والتوسع التقني الحديث في أعمال البناء والتشييد.
تكمن مشكلة هذه الدراسة في أن صيغ عقود مقاولات البناء والتشييد التقليدية أصبحت لا تتماشى مع التطور الهائل المستمر في قطاع الإنشاءات، وبخاصة ما يتعلق منها بالإستشارات الهندسية.
