موضوع البحث، ما يوحي بذلك عنوانه، هو دراسة الأدلة الجنائية المتحصلة بالمخالفة للقانون بالمعنى الواسع: فإذا كان قانون الإجراءات الجنائية يسعى إلى التوصل إلى الحقيقة باعتبارها غاية العدالة الجنائية فى كل نظام، إلا أن التساؤل يثور مباشر حول السبل والقنوات المقبولة التي يتعين سلوكها وصولًا إلى تلك الغاية: قبل تستوي كافة الوسائل في نظر القانون؟ وهل يبرر نبل الغاية دناءة الوسيلة؟ وما هي الحقيقة التى يحرص نظام إدارة العدالة الجنائية على بلوغها: هل هي "الحقيقة" من حيث مادياتها ليس إلا؟ أم هي الحقيقة فى قالب قانوني محدد؟ وتثور هذه التساؤلات وغيرها في إطار محدد تخبرناه لدراستنا وهو "القيمة القانونية" للأدلة المتحصلة بطرق غير مشروعة (مع أخذ لهذا التكييف الأخير في معنى واسع) وموقف النظم الإجرائية والفقه الجنائي المقارن منها.
