إن الجريمة لم تعد بصورتها البدائية كما كانت عند ظهورها على يد قابيل بقتل أخيه هابيل في دوافعها ووسائلها وطبيعتها، فإذا كانت دوافعها في الماضي قد اقتصرت على الصراع استجابة لنزوة معينة، أو من أجل البقاء، أو رغبة في الانتقام، فإن دوافعها في الحاضر قد أخذت بعداً آخر يتصل الصراع الاجتماعى، أو السياسي، أو الاقتصادي، أو الفكري، وكما اختلفت الوسيلة وتطورت، فقد أختلفت طبيعة بعض الجرائم وتطورت تبعاً لذلك كله.
وما نحن بصدد البحث فيه ودراسته هو نوع خطير من تلك الجرائم التي أثر فيها كل ما سبق، وهى جرائم الاختطاف التي ظهرت وانتشرت على نحو يدعو للقلق، ويبعث على الاهتمام.
وتظهر أهمية موضوع هذه الدراسة في أن الاعتداء على الإنسان هو اعتداء على الجماعة، واعتداء على النظام الاجتماعى فيها، وذلك لأن الإنسان هو الأصل في المجتمعات والدول، ومن أجله وجدت النظم وشرعت الشرائع، ويزداد خطر هذا الاعتداء حينما يقع على ما يمثل جوهر الحياة لدى الإنسان وأغلى ما عنده وهى (الحرية).
وقد قسمت هذه الدراسة إلى خمسة فصول، خصص الفصل الأول للأحكام العامة في جرائم الاختطاف، وفيه بيان مفهوم جريمة الاختطاف، وخصائص جريمة الاختطاف، وتمييز جريمة الاختطاف عن غيرها مما يشتبه بها.
والفصل الثانى لدراسة أركان جريمة الاختطاف: محل الجريمة، والركن المادي للجريمة، والركن المعنوي فيها.
والفصل الثالث لبيان صور جريمة الاختطاف بدراسة الاختطاف المتخذ صورة الحرابة، والاختطاف المتخذ صورة الجريمة السياسية، والاختطاف الذي يكون الجنائي فيه فرداً والاختطاف الذي يتعدد فيه الجناة.
والفصل الرابع لعقوبة جريمة الاختطاف في القانون اليمني والقانون المصري، والفقه الإسلامي.
أما الفصل الخامس فقد خصص لدراسة الجرائم المرتبطة بجريمة الاختطاف، وهى: جريمة احتجاز الأشخاص، وجريمة إخفاء الممتلكات، وجريمة الإيذاء الجسدي، وجريمة الاغتصاب، وجريمة الابتزاز.
وأخيراً الخاتمة التي تضمنت أهم النتائج التي خرج بها الباحث من خلال البحث، والمقترحات والتوصيات.
