لقد كانت حوادث السبَ عبر الأزمنة من اهم الأسباب التي دفعت الأئمة للتصنيف في هذا الموضوع، كما أن الخلاف الواقع في فروع هذه المسألة نحى بغير واحدٍ من الأئمة إلى محاولة تحريرها وتحقيق الحقَ فيها، وكان من أهمهم الإمام المجتهد شيخ الإسلام وقاضي القضاة "تقي الدين علي بن عبد الكافي السبكي الشافعي" (683هـ- 756هـ).
وفي هذا الكتاب؛ يعالج الإمام السبكي أحكام السبَ على اختلاف حالاتها، وكان الدافع إلى ذلك هو اعتراض بعضهم عليه رحمه الله في واقعةٍ حكم فيها بقتل نصراني سبَ ولم يسلم فكان ذلم داعياً إلى رد كلام هذا المعترض، لكن حد به الأمر –أي السبكي- إلى معالجة الموضوع من كافة أطرافه لا ما اقتضته تلك الحادئة فحسب. أما الحادثة كما وردت في هذا الكتاب على لسان مؤلفه: "كان الداعي إليه أن فتيا رفعت إلي في نصراني سبَ ولم يسلم، فكتبت عليها، يقتل النصراني المذكور كما قتل النبي صلى الله عليه وسلم كعب بن الأشرف، ويظهر الحناب الر فيع منولوغ هذا الكلب: لا يسلم الشرف الرفيع من الأذى، حتى يراق على جوانبه الدم. وكتب معي –والكلام للمؤلف- جماعة من الشافعية والمالكية، فأنكر ذلك بعض الناس محتجاً بقول الرافعي وغيره من الأصحاب: إن في إنتقاض عهده بذلك خلافاً، وظنَ أنه إذا لم ينتقض عهده لا يقتل، وتهجب من استدلالي بقصة كعب بن الأشرف، وقال: هذه واقعة عين –أي أن حكمها لا يتعدى إلى غيرها من الوقائع- لا يستدلَ بها لاحتمال أنه قتله بغير السَب، وربَما زعم بعض المحاولين في ذلك أن كعب بن الأشرف كان حربياً…".
وبناءً على ما تقدم يقسَم الإمام السبكي كتابه إلى أبواب أربعةٍ رئيسة: -الأول: في حكم السابَ من المسلمين، ذكر فيه وجوب قتله، ثم بحث حكم توبته واستتابته. –الثاني: في حكم السابَ من أهل الذمة، وقد أولاه مزيداً من العناية لكونه الدافع الأصلي للكتابة في الموضوع. –الثالث: في بيان ما هو سبَ من المسلمين والكفار … وقد تكلم عن هذه المسألة بجميع فروعها. – الرابع: في شيء من شرف المصطفى صلى الله عليه وسلم، خصصه الإمام لذكر طائفة من المناقب النبوية الشريفة، أردفها ببيان ما يجب على الخلق من حقوقه صلى الله عليه وسلم… هذا، وقد حقق في هذا الكتاب عن نسخة المؤلف الأصلية وعلق عليه وذيله الأستاذ، إياد أحمد الفوج.
