لا يتفق فقهاء القانون كلهم على تعريف واحد ملزم لمفهوم البيع فالمفهوم الفرنسي مثلاً يعرفه بأنه "الاتفاقية التي يلتزم فيها أحد الفريقين بتسليم شيء ما والفريق الآخر بدفع ثمن له" بينما يختلف تعريف القانون الألماني عن ذلك "إذ ينص على أنه "يلزم بائع شيء ما بأن يقوم بتسليمه للشاري وبنقل ملكية الشيء إليه.. والشاري مجبر على دفع ثمن البيع المتفق عليه وتسلم الشيء المباع".
وهذا التعارض بين القوانين يتعلق بنظام البيع أكثر مما يتعلق بموضوعه. أما البيع الدولي فإن له طابعاً دولياً، وهو عقد يشرك مصالح التجارة الدولية وله روابط بالأعمال المتعلقة بإبرامه أو بتنفيذه أو بالفريقين بالنسبة إلى تابعيتهما (جنسيتهما) أو مكان إقامتهما.
وبحسب المؤلف الدكتور "فانسان هويزه" فإن مفهوم السلع هو أيضاً غير دقيق، وقد استقر المتخصصون على تعريفه بأنه "الأشياء المادية المحسوسة" وهو تعريف تقره الاتفاقات الدولية. وف يكل الأحوال فإن بيه السلع الدولي له قوانين وأنظمة تنظمه وتبين ضوابطه.
وفي هذا الكتاب يعرض المؤلف تحديد مصادر تنظيم البيع الدولي في الجزء الأول من الكتاب، بينما يبحث في الجزء الثاني شروط تكوين بيع السلع الدولي، ويبحث في مفاعيله في ثنايا الجزء الثالث. وهو يتوجه بمؤلفه هذا إلى الذين يرغبون أن يتعرفوا في نطاق دراساتهم ومهنتهم إلى المظاهر القانونية لبيع السلع الدولي، يرتبط بوصف مجموعة هذه القواعد الموحدة، وعلى وجه الخصوص القواعد المستمدة من اتفاقيات الأمم المتحدة التي أبرمت في 11 نيسان 1980، والمطبقة في فرنسا منذ أول كانون الثاني 1988م.
