وجود الجريمة في حالة تلبس دفع المشرع الي التضييق من نطاق الحرية الشخصية للفرد وذلك بمنح مأمورى الضبط القضائي سلطتي القبض علي المتهم وتفتيش شخصه من منطلق الحرص علي جمع الدلائل التي تفيد وقوع الجريمة ونسبتها الي مرتكبها حيث انه بتوافر حالة التلبس تنتفي مظنة الخطأ أو الكيد للمتهم.
ونظرا لما يثيره موضوع التلبس بالجريمة من مشكلات في الحياة العملية فقد سعيت من خلال هذا المؤلف الي القاء الضوء علي النصوص المتعلقة بحالات التلبس وذلك من خلال تحليلها مع بيان أحكام محكمة النقض المصرية الصادرة حول هذا الموضوع. وقد حرصت أيضا علي التعرض لإتجاهات الفقه المصري والفرنسي وأيضا بعض الأحكام الصادرة من القضاء الفرنسي في هذا الشأن، لذلك سنتناول في هذا الكتاب موضوع التلبس بالجريمة وأثره علي الحرية الشخصية، وذلك في ثلاثة فصول علي النحو التالى، الفصل الأول: التلبس بالجريمة، الفصل الثاني: في القبض علي المتهمين، الفصل الثالث: في تفتيش المتهمين، وأخيرا فانني أرجو أن يكون مؤلفي هذا عونا نافعا للمشتغلين بالقانون.
