ولد بقرية برقة التابعة لمحافظة نابلس بفلسطين.
خرج من فلسطين وهو ابن ست عشرة سنة، إلى المدينة المنورة بالمملكة العربية السعودية، وأكمل دراسته الثانوية العامَة هناك، ثم أكمل الدراسة في الجامعة الإسلامية بالمدينة المنورة، وحصل على البكالوريوس من كلية الشريعة، ومكث فيها فترة من الزمن، ثم غادر إلى الكويت عام 1966م، واستكمل الأشقر رحلته العلمية بدراسة الماجستير في جامعة الأزهر، ثم حصل على الدكتوراه من كلية الشريعة بجامعة الأزهر عام 1980م، وكانت رسالته في "النيات ومقاصد المكلفين" في الفقه المقارن، وعمل مدرسًا في كلية الشريعة بجامعة الكويت.
بقي الشيخ بالكويت حتى عام 1990م، ثم خرج منها إلى المملكة الأردنية، فعيِن أستاذًا في كليَة الشريعة بالجامعة الأردنية.
وكان عميد كلية الشريعة بجامعة الزرقاء سابقا.
ثم تفرغ للبحث والكتابة، وأصدر عدداً جيداً من الكتب والأبحاث.

لا يزال أعداء الإسلام- من الكافرين والمنافقين- يتربصون به وبأهله الدوائر، ويمكرون مكر الليل والنهار؛ للقضاء عليه وعلى أهله، وصدق الله العظيم إذ يقول: "وإذ يمكر بك الذين كفروا ليثبتوك أو يقتلوك أو يخرجوك ويمكرون ويمكر الله والله خير الماكرين" [الأنفال: 30]. تعددت المخططات غير المباركة التي يحيكها أعداء الإسلام؛ للقضاء عليه وعلى أهله، وذلك عن طريق: وضعهم للقوانين الفاسدة والجائرة التي صادمت قانون الله جل وعلا في أرضه (الشريعة الإسلامية الغراء)، والتي مكنت لهم في ديار الإسلام، سعيهم سعيًا حثيثًا لإقصاء الشريعة من واقع المسلمين، بل ومن عقولهم وقلوبهم، والتحاكم إلى غير شرع الله المحكم، والعمل على إلف المسلمين للواقع القائم والمؤسس على غير شرع الله. لقد خرج علينا هذا الكتاب ليعالج- بإذن الله- جل القضايا المتعلقة بالحكم بما أنزل الله: ما حكمه؟ وما حكم من يتحاكم إلى غير شرع الله؟ ومتى يكون الحكم بالقوانين كفرًا مخرجًا من الملة ومتى لا يكون؟ كما جمع بين دفتيه زبدة أقوال أهل العلم في كل ما مر ذكره.
