يضم هذا الكتاب بين طياته كتابين من أمهات كتب الفقه المدني من القرنين الثاني والثالث الهجريين. كلا الكتابين على صيغتهما الحالية من ثمرات النشاط العلمي المبكر للمذهب المالكي بمدينة القيروان التي قد تميزت في ذلك العصر ربما أكثر من غيرها من الأمصار بالعناية بفقه أهل المدينة وبروايته ودراسته وتدوينه ونقله خارج حدود إفريقيا إلى البلاد الأندلسية وغيرها.
أما الكتاب الأول في هذا المجلد فهو معروف لدى دارسي التراث المالكي اسماً فحسب، وأصله الأندلس، وانتشر واشتهر باسم صاحبه محمد بن أحمد العتبي: العتبية، وهو المسمى أيضاً بالمسائل المستخرجة من الأسمعة مما ليس في المدونة. وبين يدينا منها في هذا المجلد الجزء الكامل لكتاب الحج.
أما الكتاب الآخر في هذا المجلد فهو من نفائس كتب الفقه القديمة من تأليف الماجشون وهو من معاصري مالك بن أنس بالمدينة.
