في هذا الكتاب يجمع "فوزي بالثابت" بين الفقه وأصوله والواقع، تحت عنوان "فقه الإجتهاد التنزيلي" بمعنى المنهج الإجتهادي الذي يجب أن يتبع في تنزيل الأحكام الشرعية على الواقع، وبذلك يكون المؤلف قد جمع ما توصل إليه السلف الصالح من فهم في التنزيل، وصوغه صياغة جديدة تلاؤم العصر الذي نعيش فيه، وأيضاً جمع متناثر زؤاهم في التطبيق بين دفتي كتاب واحد، بعد أن إحتوته كتب السابقين متفرقاً، ذاكراً أصواله وقواعده وضوابطه وعلى هذا يصف المؤلف عمله بأنه: "محاولة تجميع لمتنائر الأقوال والآراء في فقه التنزيل التي صاغها أسلطين العلم، فهي موجودة في مصنفاتهم الأصولية خاصة ومنَزلة على المسائل الفقهية حسب الحاجة، فمرة تظهر جليَة ومرة تختفي مع تفاوت في الظهور والخفاء، (....) لذلك تم هذا العمل لوضع المنهج التطبيقي في مصنف واحد، مع إدراج الواقع كمبحث نظري وعملي مع هذا المنهج(...)".
يبدأ الكتاب بمدخل عام في خصائص التشريع الإسلامي يلي ذلك خمسة فصول: أولها يحدد الواقع ومفهومه نظرياً وعملياً، مقتصراً على الواقع الإسلامي كنموذج للدراسة والبحث، وثانيها: يعطي لهذا الواقع أهميته الشرعية، بتأصيله من المصادر الأصلية –القرآن الكريم والسَنة النبوية- مؤكداً هذا بالتجارب التاريخية الراشدة في فهمه والتعامل معه. ثم جاء الفصل الثالث ليدرس ضرورة إعتماد آلات ومقومات مساعدة لفهم ودراسة الواقع ومنها القدرة على الربط والمقارنة والتحليل، والتفاعل الإيجابي مع الواقع. بعد ذلك يتطرق الفصل الرابع إلى نقطة هامة وهي ضوابط فهم الواقع بمعرفة ثوابته ومتغيراته في دراسة للسَنن وأنواعها وصفاتها، ثم يختم الفصل الخامس بالغاية من هذه الدراسة، ألا وهي التنزيل للأحكام ومنها أسس التنزيل، ومظاهر الإجتهاد، وفقه التنزيل.
