إن العلاج الحاسم لأزمة الإسكان في مصر يقتضى تناولها من منظور اقتصادي يطبق عليها قانون العرض والطلب بما يعنى ضرورة تحرير عقد الإيجار من القيود وإخضاعه لمبدأ سلطان الإرادة وعقد شريعة المتعاقدين ولقد فشلت جميع التشريعات الاستثنائية التى صدرت لتنظيم العلاقة بين المؤجرين والمستأجرين وذلك لأن هذه التشريعات لم تتناول أزمة السكن كقضية إقتصادية وبعد حدوث الكثير من المنازعات التى وصلت إلى ساحات المحاكم فقد خضعت العلاقات الإيجارية الجديدة التى تتم في ظله لأحكام القانون المدني المنظمة لعقد الإيجار بما ينطوي عليه هذه الأحكام من تحديد للمدة وإطلاق لقيمة الأجرى ويدرس الكتاب الصور المختلفة للتخلي عن المكان المؤجر ومدى جواز المستأجر عن المكان المؤجر للغير في كل من القانون المدني وقانون إيجار الأماكن مع دراسة جزاء حظر التخلي عن المكان المؤجر للغير.
