ممّا امتاز المسلمون به على سائر الأمم: إقامة العدل، والقضاء على الظلم، ورد المظالم لأهلها ونشر الأمن والإستقرار بين العباد والبلاد.
ومن ثَمَّ اهتم الخلفاء بولاية القضاء، وولاية المظالم، وأحكام الحسبة، كما اعتنى الفقهاء ببيان أحكام الشرع في شؤون الحياة عامة، وبخاصة في الأمور التي يقع فيها الظلم والتعدي على حقوق الناس، وإيذاء الآخرين، وإيقاع الضرر بمصالح العامة والخاصة، وأكل أموال الناس بالباطل، ونحوها من القضايا التي يحصل فيها الترافع والتحاكم بين أيدي القضاة.
وذهب العلامة نجم الدين الطرسوسي في كتابه هذا إلى بحث القضايا المتعلقة بالقضاء في الفصل بين المتحاكمين المتخاصمين بخاصة، بل عالج أكثر القضايا العويصة الصعبة لدى القضاة في إصدار الأحكام، فتتبع المؤلف وتقصى تلك الأمور والنوازل الغامضة في بطون أمهات الكتب الفقهية في الأبواب الفقهية المتعلقة بحياة الناس وذكرها منتقاة من كتب مختلفة، للوصول إلى الأحكام الشرعية لتلك المسائل والقضايا.
وإن كان جلّ تلك المسائل كانت في أبواب الوقف، وذلك لكثرة وقوع الخلاف بين الناس وحتى الفقهاء والقضاة بخاصة في تلك القضايا إلى يومنا هذا، ولأهمية مسائل الوقف عن سائر المسائل الفقهية؛ لما لها من تعلق دنيوي وأخروي، وما يوجد من تنوع وتفاوت بين الموقوف عليهم ونحوها من مشكلات مختلفة.
فاستخرج المؤلف لجميع القضايا الوقفية أحكاماً بطريقة غير معهودة لدى الفقهاء في التأليف، فسلك لإستنباط أحكام تلك القضايا مسلكاً فريداً: وذلك بذكر المسألة أو القضية الصعبة وعطفها بذكر ما قيل من الأحكام بطريقة الإستفهام.
