هذا الكتاب، جزء مفيد في بابهن وهو شرح العلامة محمد الأمير السنباوي المالكي (توفي سنة 1232هـ)، على نظم العلامة بهرام الدميري المالكي (توفي سنة 805هـ) للمسائل التي لا يعذر فيها بالجهل في مذهب الإمام مالك، والتي جمعها خليل بن إسحاق الجندي المالكي في أثناء شرحه لجامع الأمهات لابن الحاجب المسمى "التوضيح شرح جامع الأمهات" عند قول ابن الحاجب "ولو قالت: ما علمت أن الصمت إذن، لم يقبل على الأصح".
وهي سبع وثلاثون مسألة نظمها العلامة بهرام في أربعة وأربعين بيتاً، وشرحها العلامة محمد الأمير شرحاً جلَّى معانيها وأوضح مراميها، فجاءت سهلة ميسرة لطالبها.
تأتي أهمية هذا الكتاب من كون مسألة العذر بالجهل سواء في الأصول أو الفروع، لها ضوابط وقواعد، فليس كل جهل في الشريعة معتبراً، وليس كل جهل فيها ملغياً، لذلك يرد في هذا الكتاب ما تكلم فيه أئمة المذهب المالكي في هذه المسألة الخطيرة وما بينوا فيها من الضوابط حتى لا تختلط على من دونهم من المسلمين ومن العلماء رضي الله عنهم.
ويأتي الكتاب ليضع بين يدي القارئ المهتم نقولاً عن علماء المذهب لتجلية هذه القضية المهمة والتي تلامس حياة كل مسلم مثل البيوع والنكاح والطلاق والحدود وغيرها.
