إن دراسة موضوع الاستقرار القانوني هو في حقيقة الأمر دراسة لروح القانون، لأن القانون الذي لا يسعى إلى تحقيق الاستقرار هو في حقيقته قانون لا وجود له بل هو قانون ميت لا ينتج أثره في الحياة العملية أو في الواقع، لذلك فإن المذاهب الشكلية- وعلى النقيض من المذاهب المثالية التي تركز على قيمة العدالة باعتبارها الغاية المثالية للقانون- تعتبر أن القيمة الأولى التي يسعى النظام القانوني أو يجب أن يسعى إلى تحقيقها هي الاستقرار القانوني.
وسوف نتبع بمشيئة الله تعالى في دراستنا الراهنة الجمع بين المنهج الاستقرائي والمنهج التحليلي التاريخي حيث اقتضت طبيعة الدراسة هذا الجمع، فنتناول المنهج التحليلي التاريخي من خلال التعريف بالاستقرار القانوني وتوضيح طبيعة فكرة الاستقرار القانوني وبيان القيمة العظيمة لهذه الفكرة على مر العصور والبيئات المختلفة وكذا في المذاهب الفلسفية المختلفة وبيان آراء الفلاسفة والفقهاء، كما نركز على الجانب التطبيقي لفكرة الاستقرار القانوني عن طريق بيان دور التشريع والقضاء والفقه ونقوم بتحليل الآليات التي عملت على تحقيق فكرة الاستقرار القانوني.
ولبلوغ هدف البحث سوف نتناول موضوع الاستقرار القانوني كغاية من غايات القانون في مقدمة وبابين، وخاتمة وقائمة بأهم المراجع المستمد منها مادة البحث، الباب الأول بعنوان ماهية الاستقرار القانوني وآليات تحقيقه، والباب الثاني بعنوان الإستقرار في النظام الإسلامي والقانون المصري المعاصر.
