إن نظام الحكم الإسلامي من أهم ما ينبغي أن تنصرف أذهان الباحثين إلى دراسته، سعياً لبناء مؤسسات الحكم على أساس شرعي، لأن المصالح والمفاسد الناتجة عن تطبيقه تعم الأمة بأسرها. فهذا الكتاب يتحدث عن واسطة العِقد في هرم نظام الحكم الإسلامي، المكون من رئيس الدولة الذي يحتل قمته، والعامة التي هي قاعدته، وأهل الحل والعقد الذين يمثلون العامة. وتتجلى أهمية البحث فيما يلي: ـ إزالة الاضطراب الذي وقع بين العلماء في تعريفاتهم لأهل الحل والعقد. ـ إبراز الوظائف السياسية المهمة المنوطة بأهل الحل والعقد. ـ تقديم البديل الإسلامي في مسألة تمثيل العامة في اتخاذ القرار في الدولة. ـ اقتراح الحلول الإسلامية لمعالجة كثير من سلبيات النظم الوضعية. أما المنهج الذي اتبعه المؤلف فهو المنهج الاستقرائي التحليلي، ويعتمد هذا المنهج على الاجتهاد في أحكام الحوادث المستجدة، عن طريق استقراء النصوص، والنظر في تاريخ الدولة الإسلامية، خاصة تاريخ الخلفاء الراشدين، للتوصل إلى الحكم الشرعي، الذي يحقق غاية التشريع الإسلامي في جلب المصلحة ودرء المفسدة. وقد تضمن البحث تمهيدا، وأربعة فصول وخاتمة. ففي الفصل الأول: تحدث عن مفهوم أهل الحل والعقد في نظام الحكم الإسلامي. وفي الفصل الثاني: تحدث عن مشروعية وجود أهل الحل والعقد. وفي الفصل الثالث: تحدث عن نظام أهل الحل والعقد، وذكر الشروط الواجب توافرها فيهم، واختيار أهل الحل والعقد. الفصل الرابع: مسؤولية أهل الحل والعقد، السياسية، والتشريعية، والرقابية. ثم ختم الكتاب بالخاتمة، وأهم النتائج التي توصل إليها.
