تقول المادة 114 من قانون الإثبات رقم 25 لسنة 1968 أنه "يجوز لكل من الخصمين أن يوجه اليمي الحاسمة إلى الخصم الآخر على انه يجوز للقاضي أن يمنع توجيه اليمين إذا كان الخصم متعسفًا في توجيهها.
ولمن وجهت إليه اليمين أن يردها على خصمه على أنه لا يجوز الرد إذا انصب اليمين على واقعة لا يشترك فيها الخصمان بل يستقل بها شخص من وجهت إليه اليمين.
وفي إطار ذلك يأتي هذا الكتاب متناولًا القواعد العامة في الإثبات المدني في بابه الأول، ثم أحكام وقواعد اليمين الحاسمة في الباب الثاني منه متناولًا إياها في ضوء الآراء الفقهية وأحكام المحاكم وسلطة المحكمة في توجيهها أو منعها، وأيضًا أحكام وقواعد اليمين المتممة ويمين التقويم، وكذلك تطبيقات من أحكام المحاكم المختلفة والصيغ القانونية، وذلك في إطار سلسلة القانون للجميع هذه السلسلة التي نقدمها لكل من يهمه العمل القانوني في كل فروعه المختلفة وفي كل كتيب منها نختار أحد المواضيع في أي فرع من فروع القانون التي عملنا بها طوال حياتنا القضائية التي قاربت الأربعون عامًا والتي يكثر فيها الجدل والنقاش ونلقي عليه الضوء بآراء الفقهاء وأحكام القضاء حتى نلم بجميع جوانبه بحيث يكون في متناول كل قارئ وباحث في زمن صعب فيه الحصول على الموسوعات الفقهية والمراجع القضائية.
