يتوزع الكتاب على قسمين يرتبطان ببعضهما ارتباطاً وثيقاً: فالأول هو القسم الأصول، ويتناول منهجية تحديد الأحكام الفقهية والقطعية الثابتة وضوابط تغيرها، كما يناقش العلاقة بين المجتهد والعامي بمساحات القطع والظن في الشريعة. أما القسم الثاني، وهو القسم الفقهي فيتناول القواعد التأصيلية لتلك الأحكام وطريقة معالجتها من خلال المذاهب الأربعة: الحنفية والمالكية والشافعية والحنابلة.
ولبناء صورة واضحة لقضية الثبات والتغيّر المرتبطة بالأحكام القطعية، تقدم الباحثة بصورة موسعة عرضاً لنموذجين تطبيقيين تكتمل بهما الصورة بتحقيق الصلة بين التأصيل والتطبيق، الأول يدرس حق الزوج في تقييد خروج زوجته من المنزل، والثاني يدرس ما يجب على المرأة ستره أمام الأجانب، وهما من المسائل التي تحتاج إلى مزيد تأصيل وتحرير يأخذ في الحسبان طبيعة العصر، ومقتضياته، وأولويات إعادة مقاصد الدين، وأخلاقياته، وروحه، إلى قلوب الناس، وعقولهم، وسلوكياتهم.
