إن تعلم الفرائض للإنسان ضرورة لازمة، لمعرفة الحقوق التي حدد الله تعالى أنصباءها بحكمته في تركة الموَرِّث، على وجه العدالة الحكيمة، والإنصاف الرشيد، إذ يسعى الإنسان في مجال العمر للكسف في تأمين العيش، ثم يترك لأولاده وأهله من بعده ما يملكه، ومن ثم تتسابق الأطماع إلى إقتسامه، وقد يتسلط الهوى في ذلك، ويتحكم العُرْف الجائر، فيَحْرِم من يستحق، ويعطي من لا يستحق، كما جرت عليه الأمم القديمة، وكثير من الشعوب الحديثة التي وضعت لذلك القوانين المختلفة، أو أنكرت الميراث برمته وجعلت المكتسبات ملكاً عاماً للدولة.
فكانت الشريعة الإسلامية الحكيمة قد أقامت معالم الحق على أعدل نظام، وأتم الحكام، وعلى أصح الوجوه، وأقوم السبل، فأنصفت المحرومين، ومنحت المستحقين على مراتبهم ودرجاتهم، دون غضاضة فكان علم الفرائض قانون الحقوق، ونظام الأنصباء، في تعاقب الأسَر على مر الدهور، وجرى عليه غير المسلمين في الممالك الإسلامية زمناً مديداً...
وقد رغبت أن أوضح عدالته وأصالته، وأقارنه بمواريث كثير من الأمم على إختلافها، فوضعت كتابي هذا، وأسميته: الميران العادل في الإسلام: بين المواريث القديمة والحديثة، وقد ضمَّنته الميراث المعنوي، والفطري تتميماً للفائدة، وما يجري مجرى الإرث من الوقف الذري، والأراضي الأميرية، وما صدر بذلك من القوانين، وما قام فيه مقام بيت مال المسلمين من الأوقاف الإسلامية بصورة إضطرارية.
