إذا كانت العلاقة بين المسلمين وغيرهم هي الحرب، ولا التفات إلى آراء المتخاذلين، كما كانت العهود التي تفيد الإلتزام بأن لا يقاتل المسلمون من عاهدوهم هي المهيمنة على العلاقات بين المسلمين وغيرهم، وانحصرت هذه العهود في ثلاثة أنواع: النوع الأول: عقد الأمان، والنوع الثاني: عقد الموادعة أو الهدنة، والنوع الثالث: عقد الذمة موضوع هذا البحث، وقد قسمته إلى أربعة أبواب وخاتمة، خصصت الباب الأول لمقومات عقد الذمة وانتهائه، بعد ان بينت تعريفه ومشروعيته وذلك في ثلاثة فصول: ثم بينت في الأبواب الثلاثة التالية لهذا الباب آثار عقد الذمة، فخصصت الباب الثاني لحقوق أهل الذمة، وقسمته إلى فصلين، الفصل الأول: بينت فيه حقوق أهل الذمة التي هي في الأصل التزامات أو واجبات على المسلمين، وفي الفصل الثاني: بينت حقوق أهل الذمة الثابتة لهم شرعاً، لأنها من الحقوق العامة التي يستوي فيها المسلم وغيره، وفي الباب الثالث وقد خصصته لإلتزامات أهل الذمة- بينت هذه الالتزامات بعد أن قسمتها إلى التزامات مالية والتزامات غير مالية، وبينت أنواع الالتزامات المالية وأصل إلزام أهل الذمة بها ومقدارها إلى غير ذلك، وفي الفصل الثاني تعرضت لالتزامات أهل الذمة غير المالية، ولأن إجراء أحكام الإسلام على أهل الذمة يتأثر بالتزامات أهل طرفي العقد، سواء في ذلك المسلمون وأهل الذمة، فقد خصصت له الباب الرابع، فضلاً عن أهمية هذا الأثر، وقد بينت فيه مناهج الفقهاء وأقوالهم في ذلك وأدلتهم وما يترتب على هذه الأقوال، وأولى المناهج بالأخذ به، وفي الخاتمة أوجزت أثر عقد الذم في الالتزامات الواجبة على طرفي العقد وأهميته في باب معاملة غير المسلمين المقيمين في دار الإسلام على الدوام.
