تكمن أهمية دراسة هذا الموضوع في بيان ماهية الحكم الغيابي وماهية طرق الطعن بهذا الحكم بإعتباره طريقاً من طرق الطعن في الأحكام ومدى قبول هذا الطريق في بعض التشريعات المقارنة ومدى وجوده كواحد من طرق الطعن، ومن ثم النص عليها في القانون وبيان الثغرات والفجوات التي يمكن أن تظهرها الجوانب التطبيقية ومن ثم التوصل إلى كيفية معالجتها من خلال صياغة جديدة للنصوص تلافياً لما يعتريها من نقص، ولغرض الحد من إساءة الخصوم في إستخدام هذا الطريق من طرق الطعن بالأحكام وعدم إضاعة الوقت وإطالة أمد النزاع أمام القضاء إحقاقاً للحق وتحقيقاً للموازنة بين مصالح الخصوم وللعدالة الناجزة.
