تنبع أهمية النقل متعدد الوسائط من أهمية النقل بشكل عام الذي يعد ظاهرة حياتية لازمت البشرية منذ تأريخ وجودها وحياتها الأولى , تلك الظاهرة التي تزايدت أهميتها في ظل الثورات العديدة كثورة الحاويات التي تعد أحدث وسيلة نقل في العصر الحديث , وثورة الاتصالات , والمعلومات , والثورة التكنولوجية , والثورة الإنتاجية.
وأصبح هذا العقد الأداة الفعالة لتطبيق نظام اللوجستيك ( الإنتاج والتوزيع الشامل ) , ويعد أحد ركائز التجارة العالمية , والنظام الذي يحقق الكفاءة والسرعة في تداول تلك التجارة عبر الحدود والأوطان , ويعد أحد مقومات الاستثمار الأساسية , ويعد أيضاً الوسيلة الجديدة والسريعة والرخيصة لنقل منتجات الشركات العابرة للحدود , ولهذا العقد آثار خطيرة اجتماعية واقتصادية وقانونية على الدول والموانئ والقطاعات المختلفة , ولا وجود لعقد البيع الدولي إلا بعقد النقل الذي يعد أحد التزامات البائع الدولي , بل لا يتحقق التزام البائع بالتسليم إلا بعقد النقل الدولي.
ولما كان تنازع القوانين في مسائل العقود الدولية يعد أحد أهم موضوعات القانون الدولي الخاص وأدقها على الإطلاق , ولما كان أيضاً تحديد القانون الواجب التطبيق على عقد النقل الدولي يحتل أهمية قانونية وعملية في ظل تطور وازدهار التجارة الدولية فإن تحديد القانون الواجب التطبيق على عقد النقل متعدد الوسائط يحتل أهمية خاصة لأن عقد النقل الدولي ثاني أهم عقد دولي بعد عقد البيع , وفي هذا العقد تزيد مشكلات تنازع القوانين نظراً لدولية أطراف العقد الذين يزيدون عن ستة أطراف مختلفي الجنسية ومكان الإقامة ولدولية المحل وهي البضائع من جهة أخرى ولدولية التراضي الذي يتم بواسطة الوسائل الإلكترونية أحياناً من جهة ثالثة ولدولية الوسيلة المتعددة وهي وسائل النقل البري والبحري والجوي والسكك الحديدية مما يجعل الدراسة ذات أهمية خاصة.
