التفسير هو البحث عن المعنى الذي أراده الشارع من الألفاظ التي يتضمنها النص القانوني, الأمر الذي يتطلب تحليلًا لهذه الألفاظ بما يؤدي إلى الكشف عن مدلولها. ولأنه قد ينتاب ألفاظ النص أو عبارته لبس أو غموض, فيأتي دور التفسير لإزالة هذا اللبس والغموض, أما إذا كانت عبارة النص واضحة المعنى وألفاظه ظاهرة الدلالة, فقد يحدث أن تطبيقه بحالته هذه يؤدي إلى نتائج يأباها المنطق وتتعارض مع الهدف الذي تغياه الشارع من وضعه في هذه الحالة يتعين النظر في علة تقرير النص التي تتمثل في المصلحة أو الحق الذي يحميه القانون. وبذلك يكون التفسير عملية ضرورية للقواعد القانونية تسبق تطبيقها على الحالات الواقعية.
وعلى هذا فقد اشتملت خطة دراسة تفسير النصوص الجنائية على باب تمهيدي وقسمين: في الباب التمهيدي تعرضنا لمدلول التفسير في اللغة ثم في الفقه الإسلامي والفقه الوضعي, وذلك في فصلين: الفصل الأول في تحديد مدلول التفسير, الفصل الثاني: الدور القانوني للتفسير. والقسم الأول يتناول الأحكام العامة في تفسير النصوص الجنائية وهو يتضمن ثلاث أبواب هي: الباب الأول: المبادئ الأساسية في تفسير النصوص الجنائية, الباب الثاني: التحليل اللغوي لألفاظ النص, الباب الثالث: استظهار علة النص.
أما القسم الثاني فهو يتضمن الأحكام الخاصة بتفسير نصوص قانون العقوبات, وهذا القسم يحتوي على ثلاث أبواب: الباب الأول: دور مبدأ الشرعية في تفسير نصوص قانون العقوبات, الباب الثاني: تفسير نصوص التجريم والعقاب, الباب الثالث: تفسير نصوص قانون العقوبات غير التجريمية, خاتمة وتشمل خلاصة البحث والنتائج التي تم التوصل إليها.
