هذه دراسة عصرية "لنظام الحسبة في الإسلام" بعد أن ظن البعض أن الحسبة نظام إسلامي دخل ذمة التاريخ واحتوته أسفار التراث فلم يعد له أثر في العصر الحاضر. وهذا الظن غير صحيح، فالحسبة ما زالت قائمة بيننا وإن اختلفت تسميتها وتباين شخص متوليها، ومجالها ما زال حيويًا وإن اتسعت أرجاؤه وتشعبت مسالكه. ويكفي تدليلًا على هذه الحقيقة إلقاء نظرة على الاختصاصات الموزعة بين رجال الضبط الإداري والضبط القضائي والنيابة العامة، وشرطة المرور وشرطة الآداب، ووزارة الصحة ومختبراتها الفنية، ووزارتي التجارة والتموين، ومصلحة المكاييل والموازين، والشئون البلدية والقروية.... إلخ. لقد تقاسم هؤلاء جميعًا وغيرهم صلاحيات استقل بها فيما سلف "المحتسب" وأعوانه. لقد كان هؤلاء طائفة فورثتها طوائف، وكانوا يشكلون "نظامًا" فخلفته وزارات وهيئات وإدارات ومصالح.
فقد لاحظنا- مع غيرنا- ندرة التأليف المنهجي في حقيبتنا المعاصرة في موضوع الحسبة، فلم يتجاوز ما نشره المستشرقون والعرب المعاصرون في هذا المجال حد العناية بالنص وتحقيقه وإثرائه بفهارس وكشافات وملاحق، وتقديمه بمقدمات قد تطول وقد تقصر، وتعزيزه بتعليقات تدور دائمًا حول النص ولا تتجاوز ما تضمنه المتن.
وعسانا بهذا أن نكون قد وفينا بعض ما في رقبتنا للمحتسب من حقوق: العاجل منها ما أكثره، والآجل منها ما أوفره، وكلا النوعين من الحقوق واجب الأداء، مستحق الوفاء.
