Book Description
مصنف هذا الكتاب هو عبد الله بن قدامة الجماعيلي المقدسي الدمشقي، أبو محمد موفق الدين: فقيه من أكابر الحنابلة، ولد سنة 541هـ ببلدة جماعيل بنابلس قرب بيت المقدس في فلسطين، هاجر مع والده إلى دمشق، وفي تلك الفترة كان موفق الدين يحفظ القرآن ويتلقى علومه من أبيه أبو العباس. ثم رحل إلى بغداد وأقام عند الشيخ الجيلاني، ولبث في بغداد أربع سنين. ثم عاد إلى دمشق فأقام في أهله مدة ثم عاد ورحل إلى بغداد، وأخذ يتردد بين بغداد ودمشق طلباً للعلم.
قال عنه شيخ الإسلام ابن تيمية: "ما دخل الشام بعد الأوزاعي أفقه من الموفق" له الكثير من المصنفات منها الكتاب الذي بين يدينا حيث ذكر فيه أصول الفقه والاختلاف فيه ودليل كل قول على وجه الاختصار من كل قول على المختار.
فتحدث في الباب الأول عن حقيقة الحكم وأقسامه. وفي الثاني قان بتفصيل الأصول وهي "الكتاب والسنة والإجماع والاستصحاب". أما في الثالث فبين الأصول المختلف فيها، وفي الرابع تحدث في تقاسيم الكلام والأسماء وأفرد الخامس في موضوع الأمر والنهي والعموم والاستثناء والشرط وما يقتبس من الألفاظ في إشارتها وإيمائها إلى الحكم. وخصص السادس للحديث عن "القياس" الذي هو فرع للأصول وبين في السابع حكم "المجتهد" الذي يستثمر الحكم من هذه الأدلة و"المقلد"، أما في الفصل الثامن والأخير فذكر ترجيحات الأدلة المتعارضة.
