Book Description
عرف أكثر العلماء أصول الفقه بأنه: (العلم بالقواعد الكلية التي يتوصل بها إلى استنباط الأحكام الشرعية العملية من أدلتها التفصيلية). ونظراً لأهمية هذا العلم في حياة المسلم والحاجة الماسة إليه، اتجه العلماء إلى التصنيف في هذا الصرح الشامخ، ونهض الفقهاء في مختلف المذاهب للتأليف في علم أصول الفقه، وظهر أئمة أعلام اشتهروا بهذا العلم. كما اشتهر فيه عدد من الفقهاء والمفسرين والمحدثين الذين عملوا على خدمة هذا الدين.
ومن هؤلاء الأعلام الذين كان لهم سبق في هذا المضمار، شيخ الإسلام موفق الدين ابن قدامة (541-620هـ)، الذي احتل كتابه "روضة الناظر وجنة المناظر"-في أصول الفقه-مكانة مرموقة بين كتب أصول الفقه الحنبلي، لأنه يبرز مذهب الحنابلة، مع ذكره للمذاهب الأخرى.
وهذا الكتاب فرع عن كتاب "المستصفي" للغزالي (ت 505هـ)، لأنه تلخيص منه واختصار له، مع إظهار مذهب الحنابلة في الأصول والفروع، وعرض آراء العلماء مع اختلاف مذاهبهم، ومناقشة آرائهم.
وقال ابن قدامة في مقدمته: (فهذا كتاب نذكر فيه أصول الفقه، والاختلاف فيه، ودليل كل قول على المختار، ونبين ما نرتضيه، ونجيب من خالفنا فيه).
وقد استهل المصنف كتابه بمقدمة في علم المنطق، وبيان معنى الفقه وأصول الفقه. وترتيبه لمواضيع هذا الكتاب جاء مخالفاً لما سار عليه أكثر المصنفين في أصول الفقه. وقد ذكر ابن قدامة في أول كتابه المواضيع التي بحثها إجمالاً قائلاً: (بدأنا بذكر مقدمة لطيفة في أوله ثم أتبعناها بثمانية أبواب:
الأول: في حقيقة الحكم وأقسامه.
الثاني: في تفصيل الأصول وهي الكتاب والسنة والإجماع والاستصحاب.
الثالث: في بيان الأصول المختلف فيها.
الرابع: في تقاسيم الكلام والأسماء.
الخامس: في الأمر والنهي والعموم والاستثناء...
السادس: في القياس الذي هو فرع للأصول.
السابع: في حكم المجتهد الذي يستثمر الحكم من هذه الأدلة والمقلد.
الثامن: في ترجيحات الأدلة المتعارضة).
والكتاب مختصر ويقع في مجلد. ونظراً لأهمية هذا الكتاب ولما احتواه من عظيم الفوائد، وجليل المزايا عمدت "فاتن محمد لبون" إلى إعادة تحقيقه وتقديمه بحلة جديدة حتى يتم النفع به.
