سوف نقوم بتخصيص دراستنا هنا لأهم حتى يتمتع به المؤلف ألا وهو "الحق الادبى" فسمو ذلك الحق على الحق المالى لا يحتاج إلى تدليل أو برهان، ويكفى أن نذكر المهمة الاساسية التى يضطلع بها من أجل أن تعر فالفرق الكبير بين حق تنحصر وظيفتة فى تمكين الؤلف من الاستغلال المالى، وحق يدافع عن الشخصية الأدبية للخالق عبر مصنفه ضد الاعتداءات المحتملة، علاوة على قيامة بتوفير المناخ الملائم لظهور المصنف فى الصورة التى يرضي بها المؤلف، بإعطاء الاخير مطلق الحرية فى تحديد اللحظة الى يقرر فيها خروج المصنف من حيز الكتمان الى رحابة النور والانتشار.
سنقسم هذه الدراسة إلى قسمين: القسم الأول: نخصصة لدراسة النظرية العامة للحق الأدبى، ويحتوى هذا القسم على بابين: نعالج فى الباب الاول الطبيعة القانونية لحق المؤلف وتطور نظرية الحق الادبى مهتمين فى هذا المجال بما استجد من نظريات حديثة، أما الباب الثانى فسنخصصة لدراسة التعريف بالحق الادبى وخصائصه، مع التركيز على بيان الوظيفة التى من أجلها أعترف المشرع بالحق الأدبى وكيف يمكن معالجة تعسف استعمال المؤلف لذلك الحق.
القسم الثانى: ونخصصه لدراسة التطبيقات العمليه للحق الأدنى، وسنقسم هذا القسم الى بابيين: نتكلم فى الباب الاول منهما عن الحق الأدبى فى حياة المؤلف موضحين الامتيازات الايجابية والامتيازات السلبية التى يخولها ذلك الحق إلى خالق المصنف الادبى أو الفنى، وكيف يمكن حماية الحق الادبى من الأعتداءات المختلفة، ونتكلم فى الباب الثانى عن الحق الأدبى بعد وفاة المؤلف وما يطرأ علية من تغيرات ومن هم الأشخاص الذين سيقومون بحراسة المصنف بعد وفاة المؤلف.
